CIVIL APPLICATION (CAO) NO. 177 OF 2024 .
By the present Application, the Applicant/Appellant is seeking to condone the delay of 72 days in filing Application for restoration of Family Court Appeal.

For the reasons set out in the Application, Civil Application is allowed as prayed for.

Misc. Civil Application be registered.

Experience show that when the Application is filed for restoration of Appeal, invariably the Counsel do not annex

It is extremely important to go through the order of the Registrar to understand the conduct of the parties. In a given case, despite repeated opportunities, office objections are not removed. In such eventuality, while considering restoration application, this conduct attains significance and appropriate order could be passed accordingly.

The Registry is, accordingly, directed to not accept the Application seeking restoration of Appeal without the copy of order refusing registration or dismissing the Appeal is annexed with the Application.
4.
Copy of order be sent to the Registrar (Judicial) of this Court for issuing appropriate directions to the Registry. 5.
