CORAM:
ARIF S. DOCTOR, J DATED:
21st November 2024 PC:- 1.
The present Interim Application is filed for condonation of delay of 115 days in filing of the said First Appeal. The Learned Counsel appearing on behalf of Respondent No. 1 opposes the said Application, however, does not seek to file a formal Affidavit in Reply. 2.
Having perused the Interim Application, I find that sufficient cause has been shown to condone the delay. Also, I find that in any view
24-1-IA-1104-2024-IN-FAST-34013-2023.DOC of the matter, the delay is not of such an inordinately long in nature so as to cause prejudice. Interim Application is thus accordingly allowed in terms of prayer clause (b), which reads thus: "(b) This Hon'ble Court be pleased to condone the delay of 115 days occurred in filing present first appeal."
