Interim Application has been preferred seeking condonation of delay of 37 days caused in filing the Appeal. 2.

Learned Counsel appearing for the Appellant submits that Appellant was suffering from various health related issues and could not give instructions to his Advocate as such there is delay of 37 days in filing Appeal.

Learned Counsel appearing for the Respondent submits that there is no sufficient explanation tendered for the delay of 37 days. 4.

The specific pleading is that the Appellant is a senior citizen and was suffering from various health related issues due to which Patil-SR 1 of

59 Ia-8011-2024.doc appropriate instructions could not be given to the Advocate. There is no reason to doubt the said explanation considering the short duration of delay.

In the light of above, delay of 37 days is condoned. Interim Application stands allowed.
