Interim Application has been preferred for bringing on record the legal heirs of the deceased Appellant No.1(e), who expired on 19th January, 2020.

Learned counsel appearing for the Applicant submits that there is a delay of 347 days caused in preferring the Application for which sufficient explanation is given in the application. She further points out that the Appellant No.1(e) had expired during COVID and the information about the same received later-on and there is delay. 3.

Learned counsel appearing for the Respondent does not seriously oppose the application.

For the reasons stated in the application, the delay of 347 days is condoned and the abatement is set aside. Interim Application stands allowed. Amendment to be carried out within period of six weeks.
