Interim Application has been preferred seeking condonation of delay of 150 days caused in preferring the First Appeal. Learned counsel appearing for the Applicant, who is the original claimant, submits that it is only after obtaining legal advise that decision was taken to file the present Appeal and by reason thereof, there is delay of 150 days.

Learned counsel appearing for the Respondents does not seriously oppose the Application. Considering that the proceedings arise out of Employees' Compensation Act and the claim has been sa_mandawgad 1 of
28 ia9244-24 partly allowed and by the Appeal the enhancement is sought, the delay of 150 days is not an inordinate unexplained delay which cannot be condoned.

In light of the above, the delay is condoned. Interim Application is allowed.
