The learned AGP for the Applicant/Appellant would submit that this application for condonation of delay of 246 days in filing the First Appeal against the impugned Judgment and Award dated 7 October 2021 passed by the 3rd Jt. Civil Judge, Senior Division, Alibag, Raigad in L.A.R. No.430 of 2016. He would invite the Court's attention to paragraphs 3 and 4 of the Interim Application which according to him, would sufficiently explain the delay. 2.

In my view, after hearing the learned AGP and perusing the Interim Application, delay has been sufficiently explained and sufficient cause for delay condonation is made out.

None appears for the respondent despite being duly served as stated by the learned AGP for the Applicant/Appellant. There is also a service report of the registry of the Court, recording service to the respondent being done on 2 January 2025.

Considering the above, no prejudice would be caused to the respondent if the present application is allowed. In the interest of justice, the following order is passed:-

ORDER

(i) Interim Application is allowed in terms of prayer clause (b). No costs.
