Interim Application has been preferred seeking condonation of delay of 90 days caused in preferring the Appeal. 2.

Learned Counsel appearing for the Applicant submits that due to financial difficulty as the acquired land was no longer in possession of the Applicant, the First Appeal could not be filed within time and there is delay of 90 days.

Learned AGP submits that the delay has not been sufficiently explained.

The Application specifically pleads that the acquired land was the source of income for the Applicants and upon the same being Shubham Talle 1 of

It is also specifically pleaded that due to non payment of decretal amount the Applicant's funds were blocked and therefore it took sometime for arrange for the funds. The delay of 90 days has been sufficiently explained. 5.

In light of the above, Interim Application is allowed. The delay of 90 days stands condoned.
