Learned counsel appearing for the Respondents submits that Respondent No.1 has expired. Learned AGP submits that legal heirs of Respondent No.1, as per the information given by counsel for the Respondents will be impleaded. Leave granted. Amendment to be carried out during the course of the day.

The instant Interim Application has been preferred seeking condonation of delay of 122 days caused in preferring the First Appeal. 3.

Learned AGP would point the explanation given in paragraph no.3 and would submit that due to various sanctions and approvals required and due to intervening Covid-19 pandemic there has been Patil-SR 1 of

904 Ia-12427-2024.doc delay of 122 days in preferring the appeal.

Learned counsel appearing for the Respondents would oppose the application and would submit that the award has been passed on 28th April 2021 and the claimants have been deprived of the benefit of compensation.

Considering the sequence of events set out in the application and particularly considering the fact that during the said period, the country was reeling under Covid-19 pandemic, sufficient explanation is tendered for condonation of delay. Hence, delay of 122 days caused in preferring the First Appeal is condoned. Interim application stands allowed.
