Interim Application has been preferred seeking condonation of delay of 247 days caused in preferring the First Appeal. 2.
Mr. Sonavane, learned AGP would submit that the impugned judgment and award was passed on 6th October, 2021 and as per the order of Apex Court in suo motu Writ Petition No. 3 of 2020, the period of limitation was extended up to February, 2022. He submits that due to intervening COVID-19 pandemic, offices were functioning partially and it is only in August, 2022 that sanction was granted by the Law and Judiciary Department, Mantralaya to file the Appeal. He would submit that thereafter, requisite funds were called from Office of Collector Sairaj 1 of
23 Ia-12520-2024.doc and the Appeal came to be filed and as such, there is delay of 247 days. 3.
Ms. Punde, learned counsel appearing for Claimants does not seriously oppose the Application and submits that the Claimants have already filed the Appeal.

Paragraph No. 3 of the Application specifically pleads about permissions which were required to be obtained and dates on which, the same were obtained. As such, delay has been sufficiently explained and deserves to be condoned and is hereby condoned. 5.
Interim Application is allowed.
