Ms. Punde, learned counsel appearing for the applicantclaimant submits that the Notification in the present proceeding is of the year 1999. She submits that the law as far as amendment of a claim in a Land Acquisition matter is concerned is settled. The same can be amended even at an Appellate Stage. She refers to the Judgment of Supreme Court in case of Ambya Kalya Mhatre (DEAD) Through Lrs. And Others Vs. State of Maharashtra reported in (2011) 9 Supreme Court Cases 325 .

Considering the law as laid down by the Supreme Court in

Diksha Rane 75 IA 129102025.doc above Judgment Ambya Kalya Mhatre (supra) and after hearing the submissions made by Ms. Punde and Mr. Patil according to me, a case is made out to allow the Interim Application. 3.

The Interim Application is allowed in terms of prayer clause (A).

Amendment to be carried out within a period of four weeks from today.

5.

The Applicant is also permitted to pay the deficit Court Fees within six weeks from today.
