Present Criminal Application is listed at Serial No.23 on the Transfer Applications Board today. It is taken up for hearing at the request and exigency expressed by Mr. Parkar, learned Advocate for Applicant.

The principal relief prayed for in the Criminal Application sought transfer of the proceeding pending before the Additional Sessions Judge and Special Judge (POCSO), Thane to any other Court due to the grounds stated in paragraph No.11 of the Criminal Application.

Mr. Parkar would inform the Court that the principal ground
23.Appln.21.24.doc stated in the Criminal Application does not subsist any longer in view of the retirement of the concerned Judge at the then time and in that view of the matter he has instructions from the Applicant to seek withdrawal of the Criminal Application.

Mr. Parkar would inform the Court that Applicant alongwith her natural guardian father is present in Court and he has received instructions from the them. He would also inform the Court that Applicant is now a major.

In view of the request made by Mr. Parkar, learned Advocate on behalf of the Applicant, present Criminal Application is allowed to be withdrawn.
