Heard learned Advocate for the petitioner for some time. This petition is by the husband of respondent No.1 and father of respondent No.2. He is challenging an order dated 31.01.2023 passed by the learned Additional Sessions Judge, Latur in Criminal Appeal (PWDVA) No.4 of 2019, whereby his appeal came to be dismissed and the order passed by the learned Trial Court is confirmed. The learned Trial Court by way of judgment and order dated 03.08.2019 has partly allowed the application directing the petitioner to pay Rs.12,000/- per month to wife and Rs.10,000/- per month to his son. The Trial Court further directed to pay Rs.7000/- per month towards rent of house and Rs.1 lakh towards compensation. The learned Advocate for the petitioner submits that in-fact wife herself is a doctor and practicing in Latur. Therefore, he has challenged the order. Second submission is that from the date of marriage i.e. 16.05.2010, the wife stayed with the petitioner-husband hardly for 75 days and thereafter there is no cohabitation and all the allegations in the complaint are imaginary.
