By this revision, the applicant has challenged the order of maintenance granted by the Family Court to the respondent.

Issue notice to the respondents, returnable after four weeks.

Learned Counsel for the applicant submitted that the recovery warrant is issued against the present applicant. He has already deposited the amount of Rs.1,00,000/- before the executing Court.

The applicant is completely depend upon his pension. He is getting pension of Rs.20,000/-. The Family Court has without considering that the applicant has to incur the expenses towards his livelihood also, enhanced the amount, and therefore, the applicant has challenged the same. In view of that, the warrant executed by the executing Court be stayed.

Considering there are arrears of Rs.3,00,000/- and the applicant has already deposited the amount of Rs.1,00,000/-, the applicant shall deposit additional Rs.50,000/- within 15 days and also shall deposit Rs.5000/- towards the maintenance of respondent No.1 and Rs.4000/- towards respondent No.2 on or before 10th of every month. On this condition, the execution of the warrant be stayed till next date.

On failure to pay the said amount, the stay granted to the issuance of the warrant would be vacated automatically.

Stand over to four weeks.
