The Petitioners challenge the First Information Report dated 13th May, 2022 registered with Nigadi Police Station, PimpriChinchwad for offfences under Sections 452, 365, 387, 420 r/w 34 of Indian Penal Code (for short 'IPC') and Sections 39 and 45 of Maharashtra Money-Lending Act, 2014.

It is submitted that the FIR has been registered after a period of one year and two months from the date of the alleged incident. The incident had occurred on 3rd March, 2021. The Petitioners had filed a private complaint against the Respondent No.2 in which the concerned Court had issued process against Respondent No.2 for offences under Sections 406 and 420 of IPC Sunny Thote

33-WP-84-2024.doc and thereafter, the Respondent No.2 has proceeded to lodge the FIR.

Learned APP on instructions submit that the charge-sheet is filed against the Petitioner on 2nd January, 2024. 4.

Petitioners is permitted to amend the Petitioner to annex and challenge the charge-sheet. Amendment may be carried out within two weeks from today.

Issue notice to Respondent No.2, returnable on 27th June, 2024.
