The Petitioners are challenging the charge-sheet for offences under Section 420, 465, 468, 415, 464 r/w 34 of Indian Penal Code. The First Information Report was registered by Respondent No.2. He is the brother of the Petitioners, pursuant to directions issued in private complaint under Section 156(3) of Cr.P.C. On 31st March, 2022.

The Accused No.1 is the sister of complainant and Accused No.2 is brother of complainant. It is alleged that the father of the complainant and the Accused had died in January, 2006 and mother died in 2018. The mother had fixed deposit amount in the bank which was withdrawn by the Accused without informing the Sunny Thote

It is submitted that although the amount towards the FDR was withdrawn. On receipt of the letter from the bank, the said amount has been redeposited in the bank.

Issue notice to Respondent No.2, returnable on 26th June, 2024.

In the meantime, the trial Court shall not frame charge against the Accused till further order.
