DATE : 7th JANUARY 2025

P.C. :

1.

In this case, the Petitioner has filed C.R. No.220 of 2023 on 2nd April 2023 under Section 365 read with 34 of the Indian Penal Code, 1860 ("IPC") at Ulhasnagar Police Station in respect of missing of her husband since 1st September 2022. She has alleged that her in-laws and her husband's relatives have played a role in his missing. The investigation in that offence is still going on. Neither any charge sheet nor any police report is filed in that connection. Learned APP informs the Court that the investigation is still going on. 2.

While the investigation is going on, the Petitioner has lodged another FIR vide C.R.No.843 of 2024 at Khadakpada Police Station on 28th November 2024 under Sections 376, 354, 493, 406, 420, 325, 377 read with 34 of IPC. In that FIR, she has made certain allegations against her husband Ganesh. This FIR was filed after more than a year from lodging of her first FIR, i.e. C.R. No.220 of 2023 at Ulhasnagar Police Station.

3.

From the allegations in both these FIRs, there appears to be some overlapping connection between those allegations. To enable the Investigating Officers in both these

offences, to investigate those two offences expeditiously, and to file appropriate reports, today we are adjourning the matter. Outcome of this Petition may depend on the investigation of those two FIRs. A copy of FIR lodged vide C.R.No.843 of 2024 of Khadakpada Pollice Station is taken on record and marked "Y" for identification.

4.

In this situation, today, we are adjourning the matter.

5.

Stand over to 27th February 2025.

6.

It is made clear that we have not made any observations on merits of the matter in any manner. (S.M.MODAK, J.) (SARANG V. KOTWAL, J.)
