DATED : 26th NOVEMBER, 2025 P.C. :- 1) The learned Counsel for the Petitioner Ms. Sana Khan has submitted before us that as far as the Petitioner is concerned, the offence under Section 498-A of the Indian Penal Code has been dropped against her, as she is not the relative of the co-accused but the proceedings against her continue under Sections 323, 504, 506 read with 34 of IPC and she seek quashing of the same.

2) The learned APP Mrs. Sangeeta Shinde has placed before us an Application referred by the Senior Police Station, Mulund Police Station 1/2

Jayani 30 WP1096.2024.doc before the JMFC, 27th Court, Mulund, Mumbai on 24/11/2025 in form of Miscellaneous Application C.C.No.439/PW/2010 wherein, it is categorically prayed to the Court that the case may be taken on board and as against the accused - Radhika Ullash Shenoey in the wake of charge under Section 498-A being already dropped, action may be taken under Section 258 of Cr.P.C. as regards the remaining accusations invoking Sections 323, 504, 506 read with 34 of the IPC.

3) In the wake of the aforesaid Application, we expect the learned Magistrate to pronounce upon the same as expeditiously as possible. 4) Since the grievance of the Petitioner is taken care of by the Investigating Agency itself and the proceedings are sought to be closed under Section 258 of Cr.P.C. and if the same is allowed which would result into her release amounting to discharge, we dispose of the Writ Petition. 5) Interim Application (St.) No.17143 of 2025 stands disposed of in view of the disposal of the Writ Petition.
