Though the Respondent-Union of India has appeared and filed affidavit-in-reply, today no one is present. Amongst the various grounds, two grounds are submitted before me. One is about issuance of process by the Sessions Court without the case being committed by the learned Magistrate. Second is not deciding the sample within the statutory period as required under Rule-45 of the Drugs and Cosmetic Rules, 1945.
