After arguing the matter for some time, Mr. Saraogi, learned Counsel appearing for the Petitioners, submits that he has instructions to withdraw both Writ Petitions. However, he requests that the issues raised in the Writ Petitions be allowed to be raised at the hearing of the Criminal Appeals pending before the learned Sessions Judge.

Accordingly, both the Writ Petitions are allowed to be withdrawn and are dismissed as such, with liberty granted as aforesaid.

At this stage, Mr. Saraogi, learned Counsel appearing for the Petitioners, seeks one month's extension of time to make the deposit as per the impugned order. The extension as sought is granted.

The learned Counsel appearing for Respondent No. 1 submits that Respondent No. 1 is a senior citizen aged 80 years; therefore, the hearing of the Criminal Appeals be expedited. 5.
