The Petition seeks transfer of investigation of C.R.No.147 of 2023 registered with Kashi Mira Police Station, District Thane to CBI and/or State CID.

The learned Additional Public Prosecutor submits that in the wake of the order passed by this Court, a Committee was constituted and the Department of Forensic Medicine and Toxicology, on 29/10/2024, forwarded its report to the Investigating Officer, expressing an opinion that the deceased had died due to asphyxia due to hanging and the manner of death is suicidal in nature.
She would submit that in the wake of this report, the Investigating Officer has filed the charge-sheet under Sections
2/2 18 WP-6469-24.odt 306 and 304-B of the Indian Penal Code against the accused persons.

Learned counsel Mr.Upadhyay would, however, submit that despite the investigation being complete and the chargesheet being filed, the relief in the prayers can still survive and he would like to rely upon certain authoritative pronouncements to the aforesaid effect.

At his request, list on 22nd December, 2025 at 3.00 p.m. In the meantime, let the learned A.P.P. place on record the copy of the charge-sheet.
