Heard Mr. Himanshu Gavit, learned Counsel appearing for the Petitioner, Mr. Rajesh Jadhav, learned Counsel appearing for Respondent Nos.1 and 2 and Mr. Ghag, learned APP, for the Respondent No.3-State of Maharashtra.

By the present Writ Petition, the challenge is to the legality and validity of the Order dated 17th June 2023 passed by the learned Additional Sessions Judge-6, Nashik in Criminal Revision Application No.319 of 2018, by which the said Revision was dismissed with costs. In the said Criminal Revision Application, the challenge was to the legality and validity of the Order dated 25th September 2018 passed by the learned JMFC, Kalwan in Criminal Misc. Application No.34 of 2015, by which maintenance of Rs.1,000/- was granted to the present

04-WP-6587-2024.doc Respondent No.1 i.e. wife and of Rs.2,000/- was granted to the Respondent No.2-daughter.

It is an admitted position that the Petitioner is working in the maintenance department of Hindustan Aeronautics Limited and getting a salary of Rs.65,000/- per month.

Accordingly, no case is made out for interference in the impugned Order.

The Writ Petition is dismissed with cost of Rs.10,000/- to be paid by the Petitioner to the Respondent Nos.1 and 2. The said cost be paid within a period of 4 weeks from today.
