The learned counsel has fled the present Appeal under Section 11 of the Maharashtra Protection of Interest of Depositors (In Financial Establishments) Act, 1999 ("MPID Act") with the specifc ground, that the charge has been framed against the applicant without following the process laid down under Section 239 of Code of Criminal Procedure. Since it is alleged to be a material breach of the procedure, which has impacted the right of the accused, the present Appeal is fled, calling in question the action of framing charge on 17.03.2023 and further seeking a direction to ensure compliance of Section 239 of Cr.P.C.
