2. Under the order dated 17.10.2025 passed by this Court, this Court had recorded that the present Appeal would be disposed of in terms of the Consent Terms filed on that day. The Consent Terms were taken on record and marked "X" for identification. However, the Appellant Mr. Maghav Gupta was unable to attend the Court on that day and he was permitted to sign the Consent Terms, which were placed on record on the later date.

3. Learned Advocate Ms. Vaz, appearing for the Appellant submitted that said Maghav Gupta suffered a brain stroke and was admitted in the hospital for a prolonged period, and hence he is unable to attend this Court to complete the signing of the Consent Terms. The Appellant has already deposited an amount of Rs. 6,00,000/- to be paid to the Respondent No.2 under the Consent Terms. Since the Appellant is unable to personally sign the Consent Terms, he has today placed on record through his Advocate an authorization, under his signature which is dated 22.12.2025. The letter of authorization permits learned Advocate Ms. Vaz to represent him to sign the Consent Terms and request that the Appeal be disposed of on Consent Terms, being signed by the Advocate.

4. Consequently, Ms.Vaz appearing for the Appellant is permitted to sign the Consent Terms on behalf of the Appellant. The Consent Terms shall be signed forthwith.

5. Consequently, the Appeal shall stand disposed of in terms of the order dated 17.10.2025 and the Consent Terms taken on record.

6. The amount of Rs. 6,00,000/- deposited by the Appellant in the Registry of this Court on 01.12.2025 shall be transferred to the account of Respondent No. 2 Shubh Nirbhay Majhi , who had traveled at the relevant time from Orissa and had submitted the account details. The account details are given in the form of a photocopy of the passbook of Respondent No. 2, which was annexed to the Consent Terms. The Registry of this Court shall transfer the aforesaid amount within a period of three weeks to the said account.

7. The Appeal stands disposed of. Pending applications, if any also stand disposed of.
