The petitioner is seeking to quash the First Information Report (FIR) No.29 of 2018, registered with Murtijapur Police Station, District Akola, for the offence punishable under Sections 7, 12 and 15 of the Prevention of Corruption Act, 1988. 3.
The petitioner is a practicing lawyer of Akola and Murtijapur. A crime has been registered alleging that the petitioner has abetted a public servant i.e. Police Officers for raising demand of bribe. It is the petitioner's contention that in court premises, he has participated in the discussion of Police and conveyed the wishes of Police to the informant and nothing else. Therefore, it is the contention that none of the alleged offences would attract.

Petitioner has submitted that earlier he has applied for quashing of the same FIR in Criminal Application (APL) No.504 of 2018, however, it was came to be withdrawn. A statement is made that till date, charge-sheet has not been filed.

Issue notice to the respondents, returnable after two weeks. Learned Additional Public Prosecutor waives notice on behalf of respondents.

Learned Addl. P. P. is requested to update whether sanction has been accorded and also instruction about completion of investigation, if any.
