The petitioner is seeking to quash FIR in Crime No.365/2023 registered with Police Station Salekasa, District Gondia for the offence punishable under sections 353, 504 and 506 of the Indian Penal Code.

It is contended that the petitioner was in possession of the land since long back, in spite of that the Tahsildar directed the petitioner to remove the encroachment from the plot of respondent No.7. It is also contended that the respondent No.7 with the help of police got the illegal things done. Offences punishable under section 353, 504 and 506 of the IPC also came to be registered against the petitioner on an allegation that the petitioner prevented the Public Officer from discharging their duty while removing the encroachment. It is also

wp845.23.O.odt contention of the petitioner that the petitioner was beaten and thrashed by the police authority and false complaint has been lodged against the petitioner.

Issue notice to the respondents, returnable after four weeks.

Mr. A. B. Badar, the learned APP waives service for respondent No.1/State.

In the meantime, investigation may go on, but charge-sheet shall not be filed without obtaining leave of this Court.
