By order dated 14.12.2023, this Court has directed the Investigating Officer that the investigation may go on, but charge-sheet shall not be filed without obtaining leave of this Court. However, learned APP submitted that the charge-sheet is filed on 18.11.2023 i.e. prior to the passing of that order.

Despite the charge-sheet is filed which is not challenge in the present Application and the amendment is also not sought for last two years, learned Counsel for the Applicants, seeks withdrawal of the present Application with liberty to file fresh to challenge the charge-sheet. 3.

The Application is disposed of as withdrawn with liberty to file appropriate proceeding in view of filing of the charge-sheet.
