13. He further made a statement that Defendant No. 5 is expired and legal heirs of Defendant No. 5 are already on record but he is unable to obtain Death Certificate of Defendant No. 5. Statement is accepted.

Plaintiff to take steps to delete the name of Defendant No. 5 from the cause - title. By way of last chance, Plaintiff is directed to take steps to serve Defendant No. 13 with Writ of Summons, by all modes of service, as per Rules and file Affidavit of service to that effect on or before next date, failing Suit against Defendant No. 13 will be dismissed for non-compliance of O.S. Rule 87. Office to issue fresh Writ of Summons, if required. Plaintiff to comply with directions issued vide Practice Note No. 60-A.
