By Order dated 21.03.2025, this Authority has issued Writ of Summons against defendant nos. 4 and 5. Ld. Advocate for defendant nos. 1 to 3 by way of Praecipe pointed out Order dated 07.11.2023 passed in Leave Petition (L) No. 30529/2023 by the Hon'ble Court, by which the leave with respect to defendant no. 4 - Trust was dismissed and the Hon'ble Court granted liberty to the petitioner to again seek leave by complying the provisions of Section 92 of C.P.C..

In view thereof, directions issued with respect to issuance of Writ of Summons against defendant no. 4 vide Minutes of Order dated 21.03.2025 are hereby recalled and Writ of Summons issued against defendant no. 4 is also recalled and it be returned to the petitioner/plaintiff.

The petitioner/plaintiff to comply Order dated 07.11.2023 in true sense and purpose.

Rest of the directions issued vide Minutes of Order dated 21.03.2025 stand unchanged.
