This Petition had been disposed of inter alia imposing costs on the Respondent. However, the matter was listed today since the Respondent filed a praecipe seeking extension of time in payment of costs.

Today, Learned Counsel for the Respondent fairly states that a challenge under Section 37 of the Arbitration and Conciliation Act, 1996 ("the Act") to the order passed by me imposing such costs, has been heard by Learned Division Bench and judgment is reserved. In these circumstances, no useful purpose would be served listing this praecipe any further since the fate of the parties would be decided in the Section 37 proceeding, judgment on which is already reserved. 4.
