CORAM : SOMASEKHAR SUNDARESAN, J.

Date : June 17, 2025 Order :

1.

This is a Petition under Section 29-A of the Arbitration and Conciliation Act, 1996 ("the Act").

2.

This matter has a piquant factual matrix. Twice in the past, an extension of mandate for a period of one month was granted by a Learned Single Judge of this Court taking on the record that only the passing of the award is pending - first, on March 14, 2018 and the next on June 6, 2019. 3.

However, it is seen from the record that by an email dated July 12, 2023, the Learned Arbitral Tribunal had written an email to the parties stating that the award is ready and the arbitrator awaited a statement of June 17, 2025 Shraddha

7-ARBP-141-2025 copy.docx account regarding payment of fees owing and paid to the Learned Arbitral Tribunal until then. This was called for to ascertain the outstanding fees. 4.

Since it is apparent that the award was ready way back in 2023, the Learned Sole Arbitrator is requested to release the award with such directions as may be considered necessary to deal with the non-receipt of outstanding fees, if any as an integral part of the award. 5.

With the aforesaid direction, the mandate of the Learned Arbitral Tribunal is extended until July 18, 2025, and the Petition is finally disposed of.

6.

However, considering the peculiar nature of facts in this case, the matter is listed for ascertaining compliance on July 21, 2025. On that date, both sides shall also present to the Court a statement of the fees paid to the arbitrator in the course of the conduct of the arbitration proceedings and what fees, if any, are still owed.

7.

All actions required to be taken pursuant to this order, shall be taken upon receipt of a downloaded copy as available on this Court's website. [ SOMASEKHAR SUNDARESAN, J.] June 17, 2025 Shraddha
