When the matter was called out, I am informed that one of the by SHEPHALI SANJAY MORMARE Date: 2024.09.03 17:47:00 +0530 relief is sought for was to restrain the Respondent from creating third party rights.

The disputes and differences in the present matter arise out of a Conducting Agreement by which the Petitioner has been granted rights of the Respondent in managing certain hoardings which are owned by the Respondent. However, Learned Counsel fairly submits that pending the hearing of the present petition, third party rights have been created in respect of these very hoardings' sites. Thus, there is no question today for grant of prayer clause (a) of the Petition. The next prayer is for appointment of the Court Receiver in respect of the hoardings' sites.

However, given this is a Conducting Agreement, I am not in a position to appoint the Court Receiver for this purpose. 4.
The Learned Counsel, therefore, at this stage seeks leave to amend the present Petition. He may do so by taking out an appropriate application.
