This is a Petition under Section 9 of the Arbitration and Conciliation Act, 1996 ("the Act").

By an order dated July 10, 2025 an Arbitral Tribunal came to be appointed converting the Section 9 petitions into applications under Section 17 of the Act for consideration by the Arbitral Tribunal appointed hereby. August 4, 2025 Shraddha

It is the case of the Original Petitioner that before the Arbitrator, an application had been moved by the Respondent stating that this Court has consciously refrained from extending a certain facet of the interlocutory arrangement that had been put in place way back on September 20, 2023. The order passed by this Court on July 10, 2025 speaks for itself. If the Respondent has been advised to read it in a manner as aforesaid, it is purely the Respondent's prerogative to attempt to convince the Learned Arbitral Tribunal. It is quite apparent from the order that no deviation was made and the order dated September 20, 2023 was simply taken note of and the contents of paragraph 9 were meant to continue as they were. It is for the Respondent to convince the Arbitral Tribunal if it has a different view of the matter. Having appointed an Arbitral Tribunal, it would be inappropriate for this Court to be approached or get engaged in clarifying past orders. The Arbitral Tribunal is more than capable of handling such attempts by either party.
