Mr. Jay Jhaveri, learned counsel for the petitioner tenders an additional affidavit on behalf of the petitioner to which is annexed the consent terms filed by the parties before the Maharashtra Real Estate Regulatory Authority in Complaint No. CC006000000194632.

He points out that one of the terms set out in the consent terms is the withdrawal of this petition and some other proceedings. Accordingly, in view of the consent terms, he seeks leave to withdraw this petition.

Accordingly, we grant leave to withdraw this petition and disposed of this petition as withdrawn.

At the request of Mr. Jhaveri we direct that in case of any breach of the consent terms, the petitioner will have the liberty to take out appropriate proceedings before the Regulatory Authority and, if the law permits, even before this Court.

The additional affidavit in reply along with the consent terms is taken on record.

Writ Petition is disposed of as withdrawn in the above terms.
