This petition under Article 226 of the Constitution of India is filed praying for the following substantive reliefs : "a) That this Hon'ble Court may kindly call for the records and proceedings;

b) That this Hon'ble Court may kindly direct the Respondent no.11 to decide the Appeal/Application filed by the Petitioners within the time bound manner i.e. 6 months from the date of passing of the order;

c) Pending the hearing and final disposal of the present writ petition, this Hon'ble Court may kindly restrain the Respondent no.7 to allot the flats slum dwellers;

d) Pending the hearing and final disposal of the present writ petition, this Hon'ble Court may kindly stay the execution of the Annexure-II list dated 7.10.2009 and supplementary Annexure-II list dated 1.12.2020."

The Petitioner has pressed for the relief as prayed for in prayer clause (b), that there is a delay on the part of Respondent no.11 in deciding the Appeal dated 7th January 2023 filed before them in the year 2023. The appeal is pending disposal for over a period of two years. The non-disposal of the appeal filed by the Petitioner is causing grave prejudice to the Petitioner and the same is required to be decided expeditiously in accordance with law. 3.

In our opinion, considering the limited relief that the Petitioner seeks in the Petition and although there being no written opposition/reply of the Respondents, considering the nature of the orders we propose to pass, no prejudice must be caused to the Respondents. The followinng order would serve the ends of justice :-

ORDER

(i) Respondent No.11 - Apex Grievance Redressal Committee (SRA) is directed to hear and decide the Appeal dated 7th January 2023 filed by the Petitioner in accordance with law, as expeditiously as possible, preferably within a period of 6 weeks from the date this order is made available to the Respondent No. 11 by the Petitioner;

(ii) Let all parties be heard;

(iii) All rights and contentons of parties are expressly kept open; (iv) The Writ Petition is disposed of in the above terms. No costs. (AARTI SATHE, J.) (G. S. KULKARNI, J.) Manish Thatte
