In this Writ Petition, the Eviction Notice dated 8th February, 2023 has been inter alia assailed by the Petitioner. 2.

Due to an interim order operating in this case, the interest of the Petitioner stood protected during the pendency of this Writ Petition. However, today, when the matter is called out, Ms. Aparna Vhatkar, learned Counsel appearing for the Respondent No.1-MMRDA, has produced a copy of the order dated 4th June, 2006 to submit that the disputed premise has already been permanently allotted to the Petitioner and the same has also been accepted by him. If that be so, nothing further survives for adjudication in this Writ Petition. The learned Counsel for the Petitioner has also confirmed the said position.
