CORAM: DEVENDRA KUMAR UPADHYAYA, CJ. & ARIF S. DOCTOR, J.

DATE:

6th MARCH, 2024 P.C.:

Issue notice to the respondents.

2.

Learned Government Pleader has put in appearance on behalf of respondent nos.1, 3 and 5 to 10 and waives service of notice.

3.

Stand over to 4th April, 2024.

4.

The prayers made in this writ petition though are not happily worded, however, having regard to larger public interest involved in the matter, we entertain this petition. 5.

The petition concerns itself with the Court building at Mulund. The existing building is said to have been constructed in the year 1945 and as per the Technical Audit Report, which is reflected from a letter dated 10th April, 2017, which is on

904-WP-920-2024 record on this writ petition at page 72 as Exhibit "Q", the building is in dilapidated condition. The Technical Audit Report further clearly states that building is "Techno Economically Unfeasible". The state of the old building, thus, necessarily calls upon every stake holder to construct a new building in respect of which certain efforts appear to have been initiated way back in the year 2013, however, till date nothing concrete appears to have progressed so far as the construction of the new building is concerned.

6.

By the next date of listing, the learned Government Pleader shall have complete instructions from the State Government. The learned Government Pleader shall be briefed by the Principal Secretary, Department of Law and Judiciary, Principal Secretary, Public Works Department, Principal Secretary, Revenue Department as also by the Collector concerned.

7.

We request the learned Government Pleader to apprise all the concerned authorities of this order forthwith. (ARIF S. DOCTOR, J.) (CHIEF JUSTICE) Digitally signed by PRAVIN DASHARATH PANDIT Date:
