Writ Petition filed in the year 2024, the Petitioners have primarily assailed the NOC dated 23rd August 2019 issued by the Respondent No. 2 permitting execution of Sale Deeds by the private Respondents Nos. 4 to 7, who had eventually handed over the land in question for construction of Bullet Train Track upon receipt of compensation for the land. The Petitioners claim that they also have share over the land in question and, therefore, would be entitled to receive share in the compensation paid by the authorities for acquiring the land. According to the Petitioners, the NOC was issued in a collusive manner and in violation of the statutory provisions. Hence, the same would liable to be struck-
18-OSWP-973-2024.DOC down and a direction issued to the authorities to pay compensation to the Petitioners.

Maintainability of the Writ Petition has been questioned by the Respondents, primarily taking plea of delay and laches in approaching the Court and that statutory remedy is available to the Petitioners.

After arguing the matter for some time, Mr Pravin Tembhekar, learned counsel appearing for the Petitioners, on instructions form his clients,, seeks to withdraw the Writ Petition with liberty to pursue appropriate legal remedy for realisation of compensation for the land in question in accordance with law. 4.
The said prayer is not objected by the Respondents' counsel, subject, however, to the conditions that the provisions of law would have strict application in the matter.

After taking note of the submissions made at Bar, the Writ Petition is permitted to be withdrawn with liberty to the Petitioners to avail appropriate legal remedy in accordance with law. (SHYAM C. CHANDAK, J.) (SUMAN SHYAM, J.) {
