P.C.:- 1) Mr. Godbole, learned senior counsel appearing for the Respondent-BMC submitted that, undoubtedly there is a lapse on the part of the Officers of the Respondent-BMC in not filing replies despite directions of this Court. He submitted that, Mr. Rajendra Karanjkar, Assistant Engineer D.P. P/South Ward and Mr. Tushar Mayekar, SubEngineer, D.P. P/South were the concerned Officers who were supposed to file replies within stipulated period.
1.1) He on instructions further urged to condone the delay caused at the behest of the said Officers and permit them to file replies, the said 1/2
ssm 38-wp1431.2024.doc Officers are ready and willing to pay a cost of Rs.10,000/- each from their own pocket, to the High Court Law Library, Room No.39, 2nd Floor, Main Building, High Court, Mumbai, within a period of two weeks from the date of uploading of the present Order on the official website of the High Court of Bombay. The said statement is accepted as an undertaking given to this Court.
2) Subject to payment of aforesaid cost within stipulated period as noted above, the Respondent Nos.2, 3 and 4 are permitted to file their replies within a period of three weeks from the date of payment of costs. 3) Stand over to 26th February, 2025 at 2.30 p.m. 4) Till the returnable date, ad-interim relief in term of prayer clause (e).
