Mr. Prasad Shenoy, learned counsel is present for the Reserve Bank of India (RBI). He has produced copy of the order dated 12th December, 2025 passed by the Co-ordinate Bench in Writ Petition No.1278 of 2024 to submit that since a resolution professional has already been appointed in the present case as well, this matter also can be disposed of by issuing a similar direction, since the facts of these cases are identical.

By order dated 12th December, 2025, this Court has passed the following order :- "1.

None for the Petitioner.

Heard the learned Counsel for the Reserve Bank of India (RBI).

The learned Counsel for the RBI submits that in pursuance of this Court's order of 15 February 2024, the Petitioners applied to the NCLT to decide the issue of maintainability of the Company Petitions as a preliminary issue. He submits that the NCLT has disposed of such Interim Applications and held that the Company Petitions were maintainable. The NCLT has proceeded to even appoint a Resolution Professional. This was by orders dated 05 September 2024 and 24 September 2024.

The above orders have not been challenged in these Petitions. In any event, the Petitioners have an alternate and efficacious remedy to challenge such orders if they so desire.

Accordingly, we dispose of all these Petitions with liberty to the Petitioners or to the Resolution Professionals as the case may be to avail of the alternate remedies provided under the statute.

The Petitions are disposed of with liberty in the above terms."

After going through the record, we find ourselves in agreement with the submission made by the learned counsel for the RBI. We are also of the view that this Writ Petition can be disposed of in terms of the order dated 12th December, 2025.
