The Affidavit in Reply shall be filed on or before the next date and a copy of the same shall be served on the Advocates for the Petitioner, failing which we will proceed on the basis that Respondent No.1 has nothing to say in the matter.

The Petitioner also shall take instructions whether Indian Oil Corporation Limited (Respondent No.2) is a necessary party to the above Writ Petition as no reliefs are claimed against them and whether the Petitioner is willing to drop Indian Oil Corporation Limited from the above Writ Petition.

In the meanwhile and without prejudice to the rights and contentions of the parties, the Retail Outlet Dealership at SH 24, from Manmad Chauphully to Burkulwadi, left hand side from Manmad Chauphully towards Burkulwadi, District Nashik under SC Category shall not be allotted by Bharat Petroleum Corporation Limited to any other person, if already not allotted.
