Heard learned counsel for the Petitioner.

Ms.Sheikh, learned AGP opposed the Petition.

By this Petition under Article 226 of the Constitution of India, the Petitioner / PNB MetLife India Insurance Company Limited, prays 1/3
for a direction to the Respondent No.2-Collector, Mumbai Suburban District to forthwith grant to the Petitioner "No Objection Certificate" for transfer of the shares by Respondent No.6 in the name of the Petitioner and for the Petitioner to be granted membership of the Respondent No.6-Society. The Petitioner has accordingly sent a representation dated 17th February 2022 to the Respondent No.2Collector, Mumbai Suburban District which was received on 17th February 2022.

The property in question has been purchased in view of the registered 'Deed of Transfer' dated 27th March 2021. The Society comprises of 15 units. The request made is for transfer of the shares of Rishabh Infrastructure Private Limited in favour of the Petitioner. 5.
Considering that the shares have already been allotted, there should be no difficulty in transferring the shares since the Petitioner has purchased the said property by way of registered 'Deed of Transfer' dated 27th March 2021. Prima facie, though we find that there should be no objection for the transfer of the Petitioner's name in the Society register, considering that an application has been made to the Respondent No.2-Collector, Mumbai Suburban District, seeking 2/3
appropriate relief, we direct the Respondent No.2-Collector, Mumbai Suburban District to pass appropriate orders on the application made by the Petitioner received by the Collector on 17th February 2022 which is at Exhibit-N annexed to this Petition, within a period of 4 weeks from 17th April 2026.

The Petitioner to appear before the Respondent No.2-Collector, Mumbai Suburban District on 17th April 2026 along with copy of this order and copy of the Writ Petition.
