The learned Senior Advocate, Shri Aney, has addressed us in the light of the notice issued vide paragraph 15 of our order dated 20th February, 2025. He has graciously stated that the M.I.D.C. did proceed with the enquiry despite, the ad-interim order of this Court, dated 24th November, 2016. The M.I.D.C. is conscious of the fact that this was a lapse. Nevertheless, the M.I.D.C. did not take the matter to a logical end which could have been in the form of issuing the order of punishment.

When we called upon the learned Senior Advocate as to whether the M.I.D.C., in the light of the above, would tender an apology since the order of this Court, has been overlooked. He submits, on instructions, that an affidavit to this extent would be tendered on the next date.

List this Petition for compliance, on 7th March, 2025 so as to receive the affidavit on behalf of the M.I.D.C. 4.

Insofar as payment of cost is concerned, the learned Advocate for the M.I.D.C has handed over a cheque to the learned Advocate for the Petitioner towards payment of the full cost amount and the original cheque is received by the learned Advocate for the Petitioner, Shri Sawant.

Insofar as the release of the bank guarantee is concerned, we expect the Registry of this Court to act accordingly, expeditiously.
