The learned counsel for the petitioner submits that in the facts of the present case, this Court may consider exempting the petitioner from producing the death certificate of the deceased, who was the mother of the petitioner. It is submitted that alongwith the petition, the petitioner has produced a document issued by the Municipal Corporation of Greater Mumbai, specifying the name of the deceased and stating that the said document was an extract of the disposal register entry in the cemetery at Santacruz (West). by PRIYA KAMBLI Date:

This is an uncontested petition for grant of letters of administration, where the petitioner is the son of the deceased. It is stated that the deceased expired mid-flight, despite the fact that emergency landing was made in China, in order to treat her.

In support of the said statement made in the praecipe, a copy of a newspaper article is also annexed.

It appears that while a copy of the aforesaid certificate issued by the Municipal Corporation of Greater Mumbai is annexed at Exhibit A to the petition, the details as to the manner in which the deceased expired, have not been stated.

In this backdrop, the petitioner is directed to file an affidavit within two weeks from today, giving such details in support of the assertion that in the peculiar facts of this case, the petitioner may be exempted from producing the death certificate of the deceased. On such an additional affidavit being placed on record within two weeks from today, the petitioner shall be exempted from producing the death certificate of the deceased. 6.

Praecipe stands disposed of.
