1. Perused Petition which is filed online.

Heard Ld. Advocate for Petitioner. This Petition is for Probate of Last Will and Testament of the deceased filed by Petitioner Hema Christine Leela Nazareth, being one of the Executrix named under the Will of the deceased. Deceased Pamela Christine Nazareth, said to have died at Mumbai on 16.06.2023. Copy of death certificate is annexed to the Petition.

Identification proof of the deceased i.e. copy of Pan Card is annexed to the Petition.

2. Mr.

Lakdawala, Advocate for the Petitioner submits that deceased left behind her last Will and Testament which was duly executed at Bangalore on 04.07.2008. The said Will is in English language.

3. Mr.

Lakdawala, Advocate for the Petitioner submits that deceased was governed under the Indian Succession Act 1925. It is submitted that the The husband of the said Deceased Mr. Hubert Victor James Nazareth died on 24.08.1997, Exhibit 'E ' to the Petition is a Photo Copy of death certificate. The Son of the said Deceased Mr. Jayanth Aloysius Nazareth died bachelor on 07-06-2018. Exhibit 'F' to the Petition is a Photo Copy of death certificate of Jayanth

) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) Aloysius Nazareth. The said Deceased died leaving behind one daughter i.e. the Petitioner herein. The said name is spelled at some places as Ms. Hema Christine Leela Nazareth alias Ms. Hema Christine Nazareth both are one and the same person. Save and except as mentioned in para - 9, there are no other legal heirs left by the deceased.

4. Petitioner's Oath is filed. The another Executor, George Michael Dennis Sequeira has filed his Affidavit dated 02.11.2023 reserving his rights as Executorship.

Affidavit of Maya Mathias, one of the attesting witnesses to the Will are filed. Affidavit of service of General Citation is filed. All the Affidavits are also filed online. All other legal formalities are complied with. Hence, Petition is granted.

5. Office to issue Probate as prayed after verifying whether any Cross Petition or Caveat is filed.
