TP/354/2024 (E-filing) Mr. Siddharth Desai a/w. Suyash Kalbhor i/b. B. G. Saraf, Advocate for petitioner PC : 1. Perused Petition. Heard Ld. Advocate for petitioner. This petition is for Probate of last Will and Testament of deceased filed by petitioner namely Vijay Padamshi Bhatia and Pankaj Padamshi Bhatia being Executors named under the Will of deceased. The deceased namely Shantabai Padmshi Bhatia died at Mumbai on 26.12.2006. Copy of death certificate is annexed to the petition. Identification proof of deceased viz. copy of Pan Card is annexed to the petition.

2. The deceased left behind her last Will and Testament which was duly executed at Mumbai on 04.10.1990. The said Will is in Gujarati language and translation of the said Will is annexed to the petition and Affidavit for translation of the said Will is accepted by the Hon'ble Court as per order dated 13.03.2024. The Para Nos. 2 and 4 of the Will refers to the appointment of Executors. Only two Executors appointed under the Will who are petitioners herein.

3. Ld. Advocate for petitioner submits that parents and daughter of deceased predeceased the deceased. Deceased was survived by two sons, two granddaughters and one grandson. Out of them two sons are petitioners herein and all other legal heirs have given their consents in favour of the petitioners herein. Consent Affidavits are not filed. There are no other legal heirs.

4. Petitioner's oath is filed. Affidavit of Rajendrda Vithaldas Gondalia dated 07.10.2023 one of the Attesting Witness to the Will is filed. Affidavit of Service of General Citation dated 20.02.2024 is filed. All other legal formalities are complied with. Hence, petition is granted.
