1. Perused Petition which is filed online. Heard Ld. Advocate for Petitioners. This Petition is for Probate of Last Will and Testament of the deceased filed by Petitioners Vishal Balaram Verekar and Amitaanant Pednekar Nee Kishori Balaram Verekar being the Executor / Executrix named under the Will of the deceased.
Deceased Balaram Raghuvir Verekar, said to have died at Mumbai on 15.02.2017. Copy of Death Certificate is annexed to the Petition. Copy of Aadhaar Card of the deceased as ID Proof is annexed to the petition.
2. Mr. Parab, Advocate for Petitioners submits that deceased left behind him last Will and Testament which was duly executed and registered at Mumbai on 21.06.2010. The said Will is in English language.
3. Mr. Parab, Advocate for Petitioners submits that deceased was governed under the Hindu Succession Act, 1956. It is submitted that the Parents of the Deceased have predeceased the Deceased. Deceased have no other son except mentioned hereinabove. Deceased have no other

Madhuri Balaram, Wife of the Deceased died on 25/06/2006, being predeceased the Deceased. Vaishali Milind Verekar wife of Milind Balaram Verekar have obtained divorce on 23rd December, 2019. Save and except as mentioned in para -8, there are no other legal heirs and next of kin left by the deceased. The Ld. Adv. for the Petitioner submits that the Petitioners are unaware about obtaining any legal representation, now they have been advised to obtain Probate of the Last Will and Testament of the deceased from this Hon'ble High Court, hence the delay caused may kindly be condoned. Thus, the delay is explained.
4. Petitioners' Oath are filed. Consent Affidavits of two grandsons and married daughter of the deceased as mentioned in para 8 are on record. Affidavit of Shirish V. Bandekar, one of the attesting witness to the Will is filed. Affidavit of service of General Citation is filed. All Affidavits are filed online. All other legal formalities are complied with. Hence, Petition is granted.
5. Office to issue Probate as prayed after verifying whether any Cross Petition or Caveat is filed.
