1. Perused Petition which is filed online. Heard Ld. Advocate for the Petitioner. This Petition is for Probate of Last Will and Testament of the deceased filed by the Petitioner Chaitanya Chatuwedi son of Madhukar Chobe, being the Sole Executor named under the Will of the deceased.

Deceased Madhukar Badrilal C'hobe alias Madhukar B. Chobe alias Madhukar Chobe,, said to have died at Navi Mumbai on 29.05.2022. Copy of death certificate is annexed to the Petition. For identification proof of the deceased, copy of Aadhaar Card is annexed to the Petition.

2. Ms. Badgujar, Advocate for the Petitioner submits that deceased left behind him last Will and Testament which was duly executed on 21.03.2022. The said Will is in English language.

3. Ms. Badgujar, Advocate for the Petitioner submits that deceased was governed under the Hindu Succession Act 1956. It is submitted that the mother of the Deceased Mrs. Sumitra Devi Badrilal Choube died at Jalgaon, Madhya Pradesh on 04-01-2000. The SON of the Deceased Mr. Siddharth Madhukar Chaturvedi died on 12-08-2000 and Exhibit 'D' is photo copy of the death certificate, both pre-deceased the Deceased and he died Issuless. The said Mr. Siddharth Madhukar

) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) Chatuwedi during his life time got married to Mrs. Meenu Goel Talwar but after demise of Mr. Siddharth Madhukar Chaturvedi she got remarried, and Exhibit 'E' is a photo copy of Passport. The said Deceased had no Daughter he died leaving behind Widow, and one Son.

Save and except as mentioned in para - 8, there are no other legal heirs left by the deceased.

4. Petitioner's Oath is filed. Consent Affidavit of widow of the deceased as mentioned in para - 8 is on record. Affidavit of Rinku Kumar, one of the attesting witness to the Will is filed. Affidavit of service of General Citation is filed. All the Affidavits are also filed online. All other legal formalities are complied with. Hence, Petition is granted.

5. Office to issue Probate as prayed after verifying whether any Cross Petition or Caveat is filed.
