1. Heard Ld. Advocate for the petitioner. She submitted that she has complied with the all the requisitions as per the Chapter XXVI fo the Bombay High Court (O. S.) Rules, 1980. Properties which are subject matter of the petition belong to the deceased no. 1 to 3.
2. In para no. 5, petitioner states that deceased no. 1 has no brother, however, in view of Affidavit affirmed on 18.04.2024 it appears that deceased no. 1had one elder brother, namely Natvarlal. Hence, in view of affidavit referred hereinabove, statement made in para no. 5 is appeared to be contrary. Hence, petitioner to take steps to amend the pleading about the legal heirs in view of said affidavit as well as as per the order dated 24.04.2024. Hence, adjourned.
