1. Perused Petition. Heard Ld. Advocate for petitioner. In this matter, one Ganesh Tryambak Panse had filed Caveat being CTS No. 112 of 2024 and the same stood dismissed as per order dated 05.12.2025 passed in IA No. 4364 of 2025.

2. This petition is for Probate of last Will and Testament of deceased filed by petitioner namely Aditi Aniket Kirkole being Executrix named under the Will of deceased. The deceased namely Dr. Govind Tryambak Panse died at Pune on 19.02.2019. Copy of death certificate is annexed to the petition. Identification proof of deceased viz. copy of Aadhaar Card is annexed to the petition.

3. The deceased left behind his last Will and Testament which was duly executed at Pune on 21.07.2018. The said Will is in English language. The Para No. 5 of the Will refers to the appointment of Executrix. Only one Executrix appointed under the Will who is petitioner herein. Residuary clause in respect of properties of deceased is mentioned at last para of internal page No. 4 of the Will.

4. Ld. Advocate for petitioner submits that parents of deceased predeceased the deceased. Deceased was survived by his widow, one son and one daughter. Out of them daughter is petitioner herein and the widow and son have given their consents in favour of the petitioner herein. Consent Affidavits are on record. There are no other legal heirs.

5. Petitioner's oath is filed. Affidavit of Aditi Kirkole dated 23.11.2023 one of the Attesting Witness to the Will is filed. Affidavit of Service of General Citation dated 19.01.2026 is filed. Delay is explained and the same is condoned. All other legal formalities are complied with. Hence, petition is granted.

6. Office to issue Probate as prayed after verifying whether any cross petition is filed or whether any caveat is filed.
