TP/1347/2024 (E-filing) Mr. Sudhir Yadav, Advocate for petitioner PC : 1. Perused Petition. Heard Ld. Advocate for petitioner. Ld. Advocate for petitioner has filed praecipe dated 13.08.2025 for seeking exemption of court fees. Para No. 8 of the petition, the petitioner has stated that TP No. 329 of 2000 was filed for Letters of Administration for the estate of deceased and Letters of Administration was granted to Padmaja Padmakar Luman but she expired on 31.08.2007 without administering the estate of deceased.

2. In para No. 10 of the petition, petitioner has stated that court fees is paid of Rs.75,000/- in TP No. 329 of 2000. Photocopy of the said grant is annexed to the petition as Exhibit - "F" at page No. 41. Upon perusal of the same, it is noticed that the deceased is same in TP No. 329 of 2000 and the present petition. Therefore, estate of the deceased is same and identical and also maximum court fees is already paid. Petitioner is therefore, entitled for exemption of court fees in the present petition. Hence, petitioner is granted exemption of court fees in the present petition under section 23 of the Maharashtra Court Fees Act.
